RESPONSABILITIES:

CYNSA OPERADOR DE TURISMO S.A. - Cynsa South America (EVT Legajo 1362) explicitly declares that it solely acts as intermediary between the passengers and the various providers or individuals that render the travel services specified in its programs, namely, transportation companies, hotels, etc. Therefore, Cynsa S.R.L. disclaims any liability resulting from the damages that may occur to either the passengers who travel through its intervention or to the baggage and any other personal effects, in the programs or transfers included. Even though the organizer will facilitate and offer the means for the passengers not to take the luggage on their own it will not accept any responsibility on the passengers’ baggage or any other personal effects.

The company shall not be liable for events caused by chance and/or force majeure and/or weather conditions and/or acts of nature that may take place before or during the tour, and, prevent, delay or hinder in any way, totally or partially, the rendering of the services committed by the company.

In the event of an accident, when transportation is carried out in vehicles outsourced by the organizer, whatever country it may take place, the traveler expressly submits to the legislation in force in the country where the vehicle is registered, waiving any claim, so that any compensation due shall be paid to beneficiaries or legal representatives in the country of registration of the vehicle and in the local currency. Cynsa South America’s liability is limited to the booking and payment of the hired services according to the terms and conditions agreed with each provider. What may exceed is absolute and direct responsibility of the providers of the services hired by the passenger. If, due to personal reasons, the passenger fails to make use of the lodging, excursions, or transfers included in the itinerary, he/she shall not be entitled to any refund or claim.

For air services operated through regular flights, the carriers shall exclusively see to the conditions for surcharges, penalties, date delays and departure schedules, with whom the passenger will directly deal.

For air services operated through charters or special flights, the departure and arrival dates can not be changed for passengers. Should passengers fail to arrive at the check-in desk as early as required or should they not board the plane due to missing documentation, the flight shall be cancelled with no right to any claim, refund or reimbursement. The air company is fully responsible for the due dates and times of departures and arrivals, which could be changed if needed, for technical reasons or any other related to the activity.

BOOKINGS: Bookings shall be ensured through a 30% down payment of the total price and the balance shall be paid once the reservation is confirmed, 15 days prior to the date of departure. If the balance were not paid on the due date, the reservation shall be cancelled, with no refund of the deposit paid. Those companies making their bookings within a 15 day period prior to the departure date shall make the full payment within a 24 hour period after the confirmation of the booking. The partial or full payment implies the compliance to all and every of the above mentioned terms and conditions. Bookings already made can not be transferred. In the event of hotels and services such as Cruises, Spa or Ski Resorts, etc. that have special hiring and cancellation policies, these will be transferred to passengers.

PAYMENT: They should be done by bank deposit; passengers shall be informed about the corresponding account according to the country of origin.

PRICES INCLUDE: all services specified: transportation as stated in each program, accommodation in hotels as indicated for each case or of a similar category, in rooms with private bathroom and taxes included. For the hotel industry, a day is considered a ‘full day’ no matter what the arrival time is. Between 10 o 12 A.M. of the following day (depending on each case) the hotel ‘day’ expires, regardless of the arrival or departure time. Still, the luggage may be kept in the deposit until the time of transfer to the airport. Meals, excursions and transfers as specified in the itinerary.

PRICES DO NOT INCLUDE: unless otherwise specified: Visas, airport taxes, admission tickets to museums, National Parks, tourism local taxes and any other personal expenses (clothes’ laundry and ironing, communications, meals, tips and beverages, registration in congresses, fairs, events, etc); expenses incurred due the passengers’ decision to extend the services or to force majeure events, or those beyond the organizer’s control, and of any item not specifically detailed in the corresponding itinerary. Regarding car hire, expenses for gasoline, tax and insurance are excluded, unless otherwise specified. The rooms shall be occupied until the corresponding check out hour, beyond that time, should he/she stay longer, he/she shall pay the hotel the amount required.

TRIPLE ROOMS: In Argentina, many hotels do not have triple rooms; therefore, they offer double rooms with an extra unassembled bed which limits its comfort. Some hotels have rooms that sleep one to four people; they are generally called “Family Plan”, 2 adults and 2 children not older than 12 with 2 double beds.

CANCELLATIONS: Regardless of their cause, all cancellations must be made in written form and they will have the following penalties, applicable to the total amount paid for the trip: A) 30 days in advance the passenger losses the deposit paid. B) 15 days in advance 50%. C) Within a 15 day period prior to the trip 100%.

REIMBURSEMENTS: Claims shall be made within a 15 day period after the end of the trip with the corresponding receipts. Beyond this lapse, no claim shall be dealt with.

CHANGES AND MODIFICATIONS: We are entitled to modify or cancel any of the program stages without previous notice, if it were necessary to guarantee an improvement of the trip or due to force majeure events, as stated in the Act 18.829. If, due to unforeseen circumstances, we were compelled to call off any of the programmed services, passengers shall only be entitled to claim for the services not provided. Should the trip be shortened or extended beyond the period specified due to force majeure events out of the operator’s control, companies or hotels oversold, the corresponding expenses shall be charged to the passenger with no right to any compensation or reimbursement. In the event that the passengers suspend, modify or interrupt the services due to personal reasons, they shall not be entitled to any claim, reimbursement or compensation. The hotels specified may be changed by others of equal o higher category not farthest than 5 km from the one assigned or within the same urban area. Regarding these changes the passengers shall not be entitled to any claim.

LIFE AND ACCIDENT INSURANCE: Cynsa South America advises passengers to obtain an insurance policy with coverage in case of personal accidents, medical expenses, repatriation, cancellations, loss of luggage, personal belongings etc.

VALID PASSPORT AND VISAS: The passenger shall obtain the necessary visas and ensure that his/her passport is valid for the trip. He/she is responsible for having the corresponding visas; Cynsa South America shall not be held liable in case the passenger is denied entry into a certain country. Expenses incurred shall be paid by the passenger.

PRICES: The prices in our programs and general price lists are based in the tariffs and exchange rates valid at the time of publishing and, therefore, are subject to change without previous notice. In all cases, they are tentative and are not confirmed. The service forms shall apply to the terms and conditions mentioned in the item BOOKINGS. The rates in our Web site are not valid for groups and/or special events.

IMPORTANT: The payment or the booking implies the acceptance of the present Terms and Conditions, the conditions of each tour and the proper ones of the intervening carriers by the people concerned.
